Welcome to www.mcnielphotography.com, the website of McNiel Photography LLC, based in Wisconsin, USA. These Terms and Conditions (“Terms”) govern your access to and use of this website, as well as any services or products offered, including photography sessions, digital downloads, courses, templates, memberships, and coaching programs.

By accessing or using this website, you agree to be bound by these Terms. If you do not agree, please discontinue use immediately.

1. Intellectual Property

All content on this site, including but not limited to images, videos, course materials, digital templates, frameworks, and text, is the property of McNiel Photography LLC and is protected by copyright law. You may not copy, reproduce, redistribute, or modify any content without express written permission.

2. Photography Services

Clients who book photography sessions or wedding packages through McNiel Photography LLC will be provided with a separate, detailed client contract outlining specific terms and conditions related to services, deliverables, and expectations. However, the following general policies apply:

• Retainer & Payment:
  • Weddings: 25% non-refundable retainer required at booking; final payment due 30 days before the wedding date.
  • All other sessions: 50% non-refundable retainer required; final payment due 7 days prior to the session.
• Rescheduling & Cancellations:
  • Rescheduling is permitted on a case-by-case basis at the discretion of McNiel Photography LLC.
  • No refunds are issued for cancellations.
• Gallery Availability: Client galleries and image files remain available for one year from the date of the session or wedding. Clients are responsible for downloading and backing up their images within that period.

If you do not agree to the terms in your individual contract, you should not proceed with booking services.

3. Digital Products, Courses & Coaching

McNiel Photography LLC offers online courses, digital templates, guides, memberships, and coaching programs. By purchasing or accessing any of these products, you agree to the following:

• License of Use: Products are for your personal, non-commercial use in your own business only. Sharing, reselling, distributing, or repackaging materials without permission is strictly prohibited.
• Refund Policy: All digital products and programs are non-refundable unless explicitly stated otherwise in the sales materials for that product.
• Payment Plans: Where a payment plan is offered, you are responsible for the full purchase price regardless of whether you complete or use the program. If a scheduled payment fails, access may be suspended until the balance is brought current. Accounts that remain unpaid may have access revoked without refund of amounts already paid.
• Chargebacks: Initiating a chargeback or payment dispute after receiving access to a digital product or program is a breach of these Terms. We reserve the right to revoke access immediately and to pursue recovery of the amount owed, along with any associated fees.
• Access Duration:
  • The Booked FAST Blueprint includes 12 months of access from the date of enrollment, unless explicitly stated otherwise.
  • Memberships remain accessible for the duration of an active, paid subscription. Access ends when the subscription is cancelled or lapses.
  • Other digital products (courses, templates, guides) include lifetime access, defined as the lifespan of the product being actively offered by McNiel Photography LLC. If a product is retired, users will receive advance notice of at least 3–6 months before access is removed.

4. Coaching, Community & Communication

Some programs include community access, group calls, or direct messaging support such as voice or text coaching. The following applies:

• Communication windows, response times, and session lengths are as described in the sales materials for that offer. Support is provided during stated business hours and is not available on a 24/7 basis.
• Unused sessions, calls, or communication days do not roll over and are not refundable.
• Members and participants agree to treat others with respect. Harassment, abusive conduct, self-promotion outside designated areas, or sharing another member’s private information may result in removal without refund.
• Anything shared inside a private community or coaching container is confidential and may not be screenshotted, republished, or shared outside the group.

5. Software & Web-Based Tools

Where we provide access to a web-based tool or application, that access is provided on an “as is” and “as available” basis. We do not guarantee uninterrupted availability, and we may modify, suspend, or discontinue features at any time. You are responsible for maintaining your own copies of any content you create using our tools.

6. User Conduct

You agree not to:

• Use this site for any unlawful purpose
• Attempt to gain unauthorized access to any part of the website or its systems
• Misrepresent your identity or affiliation with any person or entity
• Harass, abuse, or harm others using the site

Violations may result in revoked access without refund.

7. Disclaimers

All educational content provided by McNiel Photography LLC is for informational purposes only and does not guarantee specific outcomes or business results.

Results Disclaimer: Any testimonials, case studies, examples, or results shared on this website, in our emails, in our advertising, or within our programs reflect the individual experiences of specific people. They are not a promise, guarantee, or representation of what you should expect. Results are not typical, and we make no guarantee of any particular level of income, bookings, inquiries, or business growth.

Your results depend on many factors outside our control, including your effort, consistency, skill, experience, pricing, market, location, and business decisions. Nothing on this site should be interpreted as a guarantee of earnings.

We are not attorneys, accountants, or financial advisors. Nothing we provide constitutes legal, tax, or financial advice, and you should consult qualified professionals for your own situation.

Photography clients should refer to individual contracts for session-specific guarantees or disclaimers.

8. Limitation of Liability

To the fullest extent allowed by law, McNiel Photography LLC shall not be liable for any indirect, incidental, special, or consequential damages arising out of the use of this website, our services, or our products. Liability is limited to the amount paid by the user for the product or service in question.

9. Third-Party Tools

This website may utilize or link to third-party platforms including Showit, WordPress, ThriveCart, Sprout Studio, Flodesk, Hello Audio, Google, Meta, and Hotjar. We are not responsible for the content, functionality, or privacy practices of these third-party tools. Please see our Privacy Policy for details on how information is handled.

10. Governing Law

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict of law principles.

11. Dispute Resolution

If a dispute arises, you agree to first contact us at emily@mcnielphotography.com and attempt to resolve the matter informally in good faith for at least 30 days before pursuing formal action. Any dispute that cannot be resolved informally shall be brought in the state or federal courts located in Wisconsin.

12. Changes to These Terms

We reserve the right to update or modify these Terms at any time. Any changes will be posted on this page with the new effective date. Continued use of the website after changes have been posted constitutes acceptance of those changes.
